ARTICLE 2: Recipient Information


ARTICLE 3: Subject

The subject of this Preliminary Information Form is the delivery of the Products whose sales and quality and sales price are specified at the end of the order, pursuant to the provisions of the Law on the Protection of the Consumer No. 4077 and the Regulation on Distance Contracts published in the Official Gazette dated 6 March 2011 and numbered 27866.

ARTICLE 4: Basic Characteristics and Payment Information of the Goods Subject to Sale

4.1. The basic features of the products can be accessed from the “www.berraart.com” address.
4.2. The prices listed and announced on the site are sales prices. Advertised prices and promises are valid until they are updated and changed. Prices announced for a certain period of time are valid until the end of the specified period.
4.3. It consists of the product number, brand/model, color, quantity, sales price, payment method and information at the time the order is finalized.
4.4. The shipping fee, which is the shipping cost of the product, will be paid by the BUYER and will not be refunded.

ARTICLE 5: Validity Period of Commitments

The prices stated in Article 4.2 are the selling price. Advertised prices and promises are valid until they are updated and changed. Prices announced for a certain period of time are valid until the end of the specified period.

ARTICLE 6: Delivery of Products

6.1. The products are delivered to the delivery address specified by the BUYER or to the person/organization at the specified address within 30 days at the latest from the date of order, in a packaged and intact manner with the invoice. This period can be extended up to a maximum of ten days, provided that the consumer is notified in writing or through a continuous data carrier.
6.2. If the products are to be delivered to another person specified by the Buyer, the Seller cannot be held responsible if the person/organization to be delivered does not accept the delivery.
6.3. The Buyer is obliged to check the Products upon receipt and immediately notify the Seller of any defects buyer sees

ARTICLE 7: Right of Withdrawal

7.1 In distance contracts related to the sale of goods, the Buyer may exercise his right of withdrawal from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery, without taking any legal or criminal responsibility and without giving any reason. Product to himself or to the person/organization at the specified address.
7.2 In order to exercise the right of withdrawal, the Seller must be notified by registered mail, e-mail or fax within 14 (fourteen) days.
7.3 In order for the returns to be processed, the return form we have sent to you must be filled in completely and put in the return package, and the return form must be filled in at "www.berraart.com".

7.4 The products to be returned must be delivered with their box, packaging and standard accessories, if any.

7.5 The Seller is obliged to return the total price and the documents that put the Buyer under debt to the Buyer within 10 (ten) days at the latest from the receipt of the withdrawal notice, and to return the goods within 20 (twenty) days.
7.6 The package of the product/products to be returned is undamaged, unused, with all accessories and the original box, after the "Returns Section" in the e-invoice is filled in and signed, Berra Ceramic's contracted cargo company, Sendeo Cargo, and Berra Ceramic, Uçhisar beldesi, Tekelli Mh. For returned product shipments, the Sendeo cargo officer should be informed that the shipment will be made with the number 11286496.
For returns made by Sendeo cargo as stated above, the shipping cost will be covered by the Seller. Seller is not responsible for shipping costs for returns sent other than Sendeo Cargo.
7.7 The decrease in the value of the goods received or the existence of a reason that makes the return impossible do not prevent the use of the right of withdrawal. However, if the decrease in value or the impossibility of return is due to the fault of the consumer, the Seller must compensate the value or decrease in the value of the goods. Changes and deteriorations that occur due to the habitual use of the goods are not considered as a decrease in value.

ARTICLE 8: Products for which the Right of Withdrawal cannot be exercised

Contracts for the sale of goods that are prepared in line with the Buyer's wishes or clearly in line with his personal needs, that are not suitable for return by nature and that are in danger of spoiling quickly or that are likely to expire, and to sound or video recordings, software programs and, provided that the packaging has been opened by the Buyer. The right of withdrawal cannot be exercised in contracts regarding computer consumables.

ARTICLE 9: General Provisions

9.1The Buyer declares in this Form that he has read the preliminary information about the basic characteristics, sales price and payment method and the delivery of the product subject to sale and has given the necessary confirmation in writing.
9.2 Buyer; By confirming this Form in writing, it confirms that before the conclusion of the distance contracts, the address to be given to the consumer by the Seller, the basic features of the ordered Products, the price of the Products including taxes, payment and delivery information are correct and complete.
9.3 The Seller cannot be held responsible for the failure of the ordered Product to be delivered to the Buyer due to any problems encountered by the cargo company during the delivery of the Products to the Buyer.

9.4 The Seller is responsible for delivering the Products intact, complete, in accordance with the qualifications specified in the order, and with warranty documents and user manuals, if any.
9.5 The Seller may supply a different Product of equal quality and price, by informing the Buyer and obtaining his written approval, if it is understood that the Products cannot be supplied for a justifiable reason before the delivery time.
9.6 If the delivery of the Products becomes impossible, the Seller informs the Buyer of this situation before the contractual performance obligation expires. If the BUYER cancels the order, the Seller returns the total price to the Buyer within 10 (ten) days. In the payments made by the BUYER by credit card, the product amount is returned to the relevant bank within 7 days after the order is canceled by the BUYER. Since the reflection of this amount on the BUYER's accounts after the return to the bank is entirely related to the bank transaction process, the BUYER may not be able to intervene in any way for possible delays and it may take an average of 2 to 3 weeks for the amount returned by the Seller to the credit card to be reflected to the BUYER's account by the bank. already accepting.
9.7 If for any reason the price of the Product is not paid or canceled in the bank records, the Seller is deemed to be relieved of its obligation to deliver the Product.
9.8 In the event that the price of the Products is not paid to the Seller for any reason, the Buyer shall return the Products to the Seller at his/her own expense, within 3 days at the latest as of the Seller's notification. All other contractual-legal rights of the Seller, including the follow-up of the Product price receivable, are reserved separately and in any case. In this case, the shipping costs belong to the BUYER.

ARTICLE 10: Competent Court

The seller submits his applications regarding complaints and objections to the T.C. Within the monetary limits determined by the Ministry of Industry and Trade in December every year, the consumer can bring the problems to the arbitral tribunal or the consumer court in the place where he/she purchases the goods or services or where he/she resides.

ARTICLE 11: Other Provisions

After this Preliminary Information Form is read and accepted by the Buyer in electronic environment, the stage of establishing a Long Distance Sales Contract will be started.
